Position Description

 

The Trade Compliance Manager - Americas will implement, monitor and control all process and procedures related to the import and export of goods to be in compliance within the customs regulations established in the United States and Mexico.  Select, manage and optimize services providers related to import and export operations (Customs brokerage, warehousing, transportation and software).    

 

Key Responsibilities

 

  • Supervise import and export operations including tariff classification, valuation, UOM, descriptions & documentation requirements
  • Select, manage and optimize services providers (Customs brokerage, bonded warehousing and software)
  • Attend internal and external audit visits related to trade compliance.
  • Audit and report on US & MX Customs brokerage activities
  • Ensure that all permits and forms are secured and submitted as required by Mexico and US Customs and OGA’s
  • Ensure the Customs compliant transfer and inventory control of fixed assets and production equipment
  • Establish and report trade compliance KPI's for US & MX.
  • Track and report additions to value such tooling and other dutiable assists
  • Monitor ZOE C Annex 24 accounting system for Mexican Customs at NLM
  • Maintain communication with Materials departments to properly manage inventory adjustments in ERP and A24 systems.
  • Manage Free Trade Agreement qualification program using the Thomson Reuters platform
  • Manage the rationalization of Customs brokers and other trade compliance service providers
  • Organize trade compliance training for US & MX personnel
  • Oversee all 3rd party services related to trade compliance
  • Oversee supply chain security initiatives (OEA, C-TPAT, etc.)
  • Provide information required by the Mexican or US authorities.
  • Review and approve duty and tax payments to Mexico and US Customs
  • Administer US Customs reconciliation programs for Modine Manufacturing
  • Supervise the correct application of tariff treaties such as USMCA and PROSEC.
  • Supervise the development and maintenance of work instructions related to import and export operations.
  • Supervise, maintain and/or develop documents related to foreign trade. e.g. Manifestation of value, Calculation sheets, Certificate of Origin, exclusions letters, power of attorney.
  • Update and train Customs department staff of changes affecting foreign trade operations (Customs Law, RCG, Fiscal Reforms, etc.)

 

Required Education & Qualifications

 

  • Bachelor degree in Customs or related
  • 5 years of experience in this area
  • Bilingual English – Spanish preferred

 

Extensive Knowledge in the following:

 

  • Customs Law, Regulations and Rules  (Mexico and USA)
  • Tariff classification of goods (Mexico and USA)
  • Tariff and non-tariff regulations (Mexico and USA)
  • Preferential and sectorial programs (IMMEX, PROSEC, REGLA OCTAVA)
  • International treaties (USMCA other Trade Promotion programs)
  • Inventory control management in accordance with Annex 24 of the RGCE (MX)
  • SCCCyG management in accordance with Annex 31 of the RGCE
  • Reconciliation of ERP, physical and Customs inventories
  • Experience in the laws of Import and Export, Brazil, Mexico and USA
  • Experience in key modes of transportation (LTL, truckload & specialized equipment)
  • Experience in international logistics (air & ocean)
  • Personnel management
  • Management of service providers
  • Supply chain security programs: C-TPAT, OEA, AEO
  • Estimated travel requirement: 25%
  • US Customs valuation reconciliation program
  • Provisional tariff programs: 301, 232, 122, IEEPA
  • Antidumping and countervailing duties
